Ask them to provide you the authority for " the student has to make a good faith attempt on each staar EOC by actually answering the questions" because that is precisely the opposite of how the TEA treats refusals. Under the TEA guidelines, the school is required to score every assessment ...

First and foremost, I would be very up front with them. Definitely follow up at the end of the year and then also before the new year starts. Make sure you specifically tell them that you do not want him in any STAAR prep classes.

OK, so your situation is your child took the 6th grade assessments and barely failed. This puts you in a slightly different situation than a parent whose kid passed them. Diane,

My post above directly addresses their improper reliance on a law that has not been enacted yet. Have you submitted the scores and gotten this as a response or just asked about it?

Did your kid take STAAR last year? If so how did he do?

Have they stated why he is in the class and why they can’t remove him?

What grade is he in?

Are the classes on his schedule as full class periods?
